The following general terms and conditions apply exclusively to all contracts concluded via the Internet by Patrick Schwarzbach Private Tutoring and Photography.
1. conclusion of the contract (only applies to subject-related tutoring)
1.1 Only the German language is available for the conclusion of the contract.

1.2.1 The offers on https://www.patrick-schwarzbach.de/private-nachhilfe-und-fotografie/themenbezogene-nachhilfe/ constitute binding offers to conclude a contract.
1.2.2 The selection made of products placed in the shopping cart can be viewed at any time at https://www.patrick-schwarzbach.de/private-nachhilfe-und-fotografie/warenkorb-2/ understand.

1.2.3 The contract is concluded with the receipt of a second e-mail (confirmation of participation) by Patrick Schwarzbach Private tutoring and photography. The customer must then arrange for payment of the fees (see 9. Prices and terms of payment). Once the money has been credited to the business account of Patrick Schwarzbach Private Tutoring and Photography, the customer will receive a payment confirmation email with an invoice. Patrick Schwarzbach Private Tutoring and Photography is entitled to cancel the order within seven working days by sending a notification without giving reasons. The customer will be informed of any non-acceptance of the order within the aforementioned period by e-mail.
1.2.4 Participation shall only be deemed to be bindingly reserved once the participation fee has been received by the provider.

2.1 Only the German language is available for the conclusion of the contract.
2.2 When using the link https://www.patrick-schwarzbach.de/ the following steps lead to the conclusion of the contract:
2.2.1 The offers on https://www.patrick-schwarzbach.de/private-nachhilfe-und-fotografie/private-nachhilfe/ are non-binding offers to conclude a contract.
2.2.2 The interested party contacts Patrick Schwarzbach Private Tutoring and Photography via the designated contact option. General terms and conditions and the instructions on the right of withdrawal (withdrawal instructions) are available on https://www.patrick-schwarzbach.de/ under the corresponding menu items. However, the request made by the customer does not constitute acceptance of the offer.
2.2.3 The contract is only concluded with a written confirmation of the conclusion of the contract by Patrick Schwarzbach Private Tutoring and Photography or the start of the service. Patrick Schwarzbach Private Tutoring and Photography is entitled to accept the contract offer made by the request within three working days by sending a contract confirmation or to reject the acceptance of the order without giving reasons. The customer will be informed of any non-acceptance of the order within the aforementioned period.
3. implementation and appointment arrangement (only applies to subject-related tutoring and individual/group tutoring)
3.1 Only the person registered for tutoring may make use of the services in accordance with the contract. Use by third parties is not permitted. Passing on access data to third parties or the use of access by other, unregistered persons is prohibited. In the event of a breach, access may be blocked.
3.2 The offers may only be used for private purposes; commercial or industrial use or public presentation is not permitted.
3.3 Dates for individual/group tutoring
The respective time for the use of the tutoring must be agreed by the customer or the registered person with the tutor Patrick Schwarzbach. The registered person must be present online or in person punctually at the agreed time. In principle, there is no entitlement to a specific appointment. The person taking part in the tutoring must log in punctually on the agreed date.
4. participation in online tutoring
4.1.1 A lesson unit for individual/group tutoring comprises 60 minutes. The number of teaching units per week is agreed individually with the person using the service. The price per lesson unit specified in the contract applies.
4.1.2 "Subject-related tutoring" takes place on a specific date and at a specific time. This information, as well as the content of the "subject-related tutoring", can be found in the product information at https://www.patrick-schwarzbach.de/private-nachhilfe-und-fotografie/themenbezogene-nachhilfe/ to take. All subject-related tutoring is a binding offer. The price is 40 € per person for a lesson period of 4-5 hours. The maximum number of participants is limited to 15.
4.2 If you miss an appointment without notifying Patrick Schwarzbach Private Tutoring and Photography, Patrick Schwarzbach Private Tutoring and Photography reserves the right to terminate the contractual relationship.
4.3 For registrations for "subject-related tutoring", in the case of bank transfers that have not been received by the day of the service date, corresponding clear evidence (transfer receipt) must be provided before the start of "subject-related tutoring" so that correct allocation can be guaranteed.
4.4 In the case of "subject-related tutoring", fees will not be refunded if the student registers but does not attend.
5. technical requirements for the use of an online offer (only applies to online tutoring)
5.1 Patrick Schwarzbach Private Tutoring and Photography points out that in order to use the online tutoring offered by Patrick Schwarzbach Private Tutoring and Photography, certain technical requirements must be met by the customer. It is the responsibility of the customer to create the technical requirements for himself or the registered person at his own expense in order to be able to use the agreed services.
5.2 Patrick Schwarzbach Private Tutoring and Photography points out that when using the Internet and the transmission of data, complete protection is not possible. It is the customer's responsibility to take the necessary precautions to secure his system.
5.3 The use of the services Patrick Schwarzbach Private tutoring and photography requires the use of software applications freely available on the Internet (third-party software). It is the customer's responsibility to download and install these software applications. The software provider does not act on behalf of Patrick Schwarzbach Private Tutoring and Photography, Patrick Schwarzbach Private Tutoring and Photography does not use the software provider to fulfill its contractual obligation to the customer.
5.4 Patrick Schwarzbach Private Tutoring and Photography reserves the right to further develop or change the software used. The customer will be informed in advance of changes and is obliged to take appropriate measures to adapt at his or her own expense within one month. In this case, the customer has the right to terminate the contract within one month of receipt of the corresponding notification.
5.5 Patrick Schwarzbach Private Tutoring and Photography recommends that you take the necessary security measures yourself and always use up-to-date virus protection.
6. scope of services
Patrick Schwarzbach Private Tutoring and Photography does not conduct distance learning courses, but provides individual tutoring, the specific scope of which is determined by the tutoring contract concluded in each case. No guarantee is given for the achievement of a specific learning outcome.
7. teaching materials
In addition to the learning materials of the public schools, other learning materials suitable for remedial teaching are used in lessons. These may not be reproduced or passed on.
8. use of the service (individual/group tutoring)
The respective time for the use of the tutoring must be agreed upon by the persons participating in the tutoring with Patrick Schwarzbach.
9. prices, terms of payment and cancellation
9.1 The prices set out in the products for "subject-related tutoring" shall apply. The agreed prices and terms of payment apply to individual and group tutoring. The services are exempt from VAT in accordance with § 19 (1) UStG.
9.2 Payment by bank transfer must be made to the account with the IBAN number: DE91 1305 0000 0201 121 45 at OstseeSparkasse BIC NOLADE21ROS, stating the purpose of the transfer, i.e. the name of the customer, the name of the subject-related tutoring and the corresponding service date.
9.3 Payment of fees for subject-related tutoring shall be made within seven days of confirmation of participation. If the service date is seven days or less after receipt of the confirmation of participation, the customer must make the payment no later than one day before the booked course.
9.4 The customer may withdraw from the booking before the start of the lesson/course without giving reasons. The withdrawal must be declared in writing by e-mail or post (for individual/group tutoring via the respective agreed communication channel). If no substitute participant can be named for the booked date, a cancellation fee will be charged in proportion to the participation fee, regardless of the reason for the cancellation. The amount is staggered and depends on the time of withdrawal:
For individual/group tutoring less than 2 hours until start: 100 %
and in case of no-show: 100 %
For subject-related tutoring less than 24 hours until start: 100 %
and in case of no-show: 100 %
10 Amendments and collateral agreements
No verbal collateral agreements have been made. Any subsequent amendments to this contract resulting from verbal agreements must be recorded in writing and signed by both contracting parties for reasons of proof.

11. revocation
Please send your notice of termination by email to info@patrick-schwarzbach.de, stating your full name, address, the keyword "online tutoring" or "subject-related tutoring" and your contract number.
